Bio/Historical Note

Chancery Records are records pertaining to chancery causes. Chancery causes are
cases of equity. According to Black's Law Dictionary they are "administered
according to fairness as contrasted with the strictly formulated rules of common law."
A judge, not a jury, determines the outcome of the case. They typically deal with cases
relating to divisions of estates or land, disputes over wills, divorces, debt, and
business disputes. Chancery causes were heard and judged in Chancery Court, which
was established in 1831 replacing the Superior Court of Law. In 1851 the Circuit
Court replaced Chancery Court, however chancery causes continued to be heard on
the local level. The chancery court's functions are distinct from those of common law
courts, which can order money damages to be paid, and where jury trials are available.
The division between chancery and equity courts is partly based on the old English
legal system. However, the original reason for the division between courts, which
was so that law courts could follow statutory rules and equity courts could rule on
issues of fairness, has been mostly lost. Chancery courts still exist in a few U.S.
states today (check with the individual court for an exact list of what types of cases it
hears). In other states, chancery court functions have been merged into the regular law
courts' activities.

�Scope and Content

The Chancery Records unit house various documents relating to the Chancery Court
in Rockingham County from the 19th century to the mid 20th century. However, a
majority of the records date between 1910 and 1930. A large portion of this collection
consists of the individual causes brought before the judge, along with their supporting
documentation. Causes are arranged chronologically, and alphabetically by plaintiff
last name. In most cases, the individual documents can be found: a "true bill"
(plaintiff's complaint), answers (defendant's response), decrees (court's decision),
depositions, affidavits, correspondence, lists of heirs, deeds, wills, slave records,
business records or vital statistics, among other items. In addition to Chancery causes,
the Chancery records contains Chancery Rule Books, Chancery Court Dockets, and
Chancery Order books. Rule Books contain the records of the session of Court where
complainant(s) began the process to have a suit heard. The Court Docket offers a
brief record of court proceeding, and the Order books served as a synopisis of all
matters brought before the court when it was in session. Because of the wealth of
information these documents provide, geneologist and researchers will find them to be
of great use.

Arrangement

This unit is arranged into two series: Chancery Causes and Chancery Books. The
Chancery Causes are arranged chronoligically based on the year the case was filed,
and alphabetically based on the last name of the plaintiff. If the plaintiff is a business
or corporation, the first letter in the name of the business if used. Because the original
order had been lost, the archivist felt this was the most logical and user friendly way
to arrange the records. Additionally, it should be made clear that a large portion of
Chancery Causes for Rockingham county prior to 1900 are housed by the Library of
Virginia and are accessible through their online index here:

All bound volumes are grouped according to same original purpose and arranged
chronoligically.

Bio/Historical Rockingham County was established in 1778 from Augusta County. In 1780, Harrisonburg was

named the county seat and incorporated as a town. The county is named for Charles WatsonWenworth, 2nd Marquess of Rockingham. Since its establishment, many individuals have called
Rockingham County their home, and unsprisingly, the record of land is quite extensive. Because of
this, the Land Records collection houses many different types of records

�Scope and
Content

The records housed within the Land Records collection vary, and a great deal of information can be
found here. All deeds, land indentures, land petitions, maps, and land tax books can be found here.
Our Maps series consists of maps, relating to the creation of the town of Shendun, Grottoes, and the
Shenandoah National Park. The Land Indenture series houses all indentures of land made in the
County of Rockingham from 1778-1850. A land indenture can be defined as a legal contract between
two parties representing the pledge, promises, and covenants of its issuing parties. In many ways,
land indentures resemble (and often act as) deeds. Petitions vary in their reasons, but many of them
were created as "attachments against property." Finally, the Land Tax Books hold annual lists of land
owners for Rockingham County from 1778 to present. Information recorded in Virginia land tax
records changes relatively little from 1782 to the present. The early laws required the tax
commissioner in each district to record in "a fair alphabetical list" the names of persons owning land
or town lots, the quantity of land owned, the value of the land or lots, and the amount of tax owed.
Each tract or lot owned by an individual was to be entered separately. As time went on, some
additional information was included such as wether the estate was held in fee or for life, distance from
the courthosue, and an explanation of alterations to the land. Land owned by African Americans
began to be listed seperatley within each district in 1891.

Deed books are arranged chronologically and are readily available on the first floor of the courthouse
in our Geneology room. Each deed book is also indexed and easily searchable through our inhouse
information management system. For this reason, they do not appear on this finding aid. The Land
Indentures and Land Petitions series are arranged chronologically, and alphabetically by the last name
Arrangement of the Grantor. All Land Tax books are arranged chronologically.

Bio/Historical
Note
Rockingham County was established in 1778 from land once incorporated under
Augusta County, but assessing property for taxation has existed as a process since
the 1600s. Beginning in the mid 17th century, local courts took over the
responsibility of accessing property and land, but in 1786 the position of
Commissioner of Revenue was established. Each year, the Commissioner assessed
taxes, and then submitted copies to the Clerk of the court, which resulted in the many
tax-related documents housed by the Circuit Court. It was also (and still remains) the
duty of the Commissioner to administer business licenses to individuals, and once
again, a certified copy was required to be filed with the Clerk of the court. The
County Treasurer was tasked with recording all taxes collected, and in turn, provided
a certified copy to the court. Many of the records in this group are created by the
Commissioner of Revenue or County Treasure, but as copies to be maintained by the
Circuit Court.

Scope and
Content

The follow record group consists of personal property tax books from 1788-1870,
delinquent tax lists from 1870-1938, capitation tax records from 1904-1933, county
treasure tax books from 1877-1931, sundry receipts, bills, and fines collected by the
county, licenses issued, costs allowed by the courts of Rockingham County from
1816-1877, and records detailing taxes belonging to the commonwealth from 18701929. These records provide information of the wealth, economic activity, race, and
occupations of my Rockingham County residents from the 18th-20th century.

There are nine series within this unit: Personal Property tax Lists, Delinquent Tax
Lists, Capitation Tax Books, County Treasurer tax Books, Miscellaneous records,
Claims Allowed, Fines Collected, Licences Granted, and Taxes Belonging to the
Commonwealth. Within each series, the documents and books are arranged
chronologically by calendar year.

                    <text>This indenture made the 19th day of June 1871 Between J G Runion overseer pf the poor for
Franklin Township in the county of Rockigham of the one part and J H Detamore of the other
part Witnesseth that the said overseers of the poor by virtue of an order of the county court made
at the June court in the year 2872 has placed and bound and by these presents doth place and
bind Daniel Franklin Detamore of the age of 15 years Son of Margaret J Detamore to be an
apprentice with him the said J H Detamore to dwell form the date of these present until the said
Daniel Franklin Detamore shall arrive at the age of twenty one years of age according to the act
of the General Assembly in that case made and provided for and during all which time and term
the said Daniel Franklin Detamore shall the said J H Detamore well and faithfully serve in all
such lawful business as the said D F Detamore shall be out unto by said J H Detamore according
to the power wit and ability of the said D F Detamore and the said D F Detamore honestly and
obediently in all things behave towards the said J H Detamore and honestly and obediently
towards the rest of the family of him the said J H Detamore. And the said J H Detamore for
himself executors and administrators doth hereby promise and covenant to and with the said
overseer of the poor and his successors in office for the time being that the said apprentice shall
be instructed in the craft and occupation of farming which he the said J H Detamore now useth
after the best manner that he can or may teach instruct and inform or to be taught instruct and
infored as much as thereunto belongeth or in any wise assertaineth and that the said J H
Detamore shall also find and allow unto the said D F Detamore sufficient meat drink apparel
washing lodging and all other things needful or nec for an apprentice during the term aforesaid.
And will moreover pay to the said D F Detamore the sum of one hundred dollars at the
expiration of the aforesaid term.
In witness where the parties to these presents have interchangeably set their hands and seals the
day and year above written.

                  <text>Series III is comprised of Rockingham County Indentures of Apprenticeship, which were formal contracts created by the overseers to bind poor or orphaned children to a "master" with who they would learn a trade. Their term generally lasted until the age of twenty-one for males and eighteen for females. Trades were typically determined by the apprentice's sex as well.
