The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. 1931, upon their oaths do present that Harrison Sillman, on or

In the Circuit Court of sa id County:
The grand jurors of the State of Virginia, in and
for the body of the County of Rockingham and now attending
said court a t its October term, 1931, upon their oaths do
present that Hobart Reedy, on or about the 20th day of
September, 1931, in said county, did unlawfully operate an
automobile while under the influence of ardent spirits,
against the peace and di gnity of the Commonwealth of
Virginia .
This indictment is found on the te s timony of J. H.
Custer, Glory Fulk, Jake Fulk, Ward Roadca p and Nora Fulk,
witnesses sworn in court and sent before the grand jury to
give evidence.

In the Circuit Court of said County:

The grand jurors of the Commonwealth of Virginiaifand for
the body of said County of Rockingham, and now attending said
court at its December term, 1931, upon their oaths do present that
Mattie Minor, Herbert Smallwood and Halsie Smallwood, within one
year next prior to the finding of this indictment, in said County,
did unlawfully have in their possession ardent spirits (moonshine
liquor), against the peace and dignity of the Commonwealth of
Virginia.
This indictment is found on the testimony of H.B. Hooke,
J. L. Logan and W. T. Rexrode, witnesses sworn in court and sent
before the grand jury to give evidence.

If only Ardent Spirits and containers be seized,
the Magistrate shall fix a time not less than 10
nor more than 30 d ays from the date of return, for
the hearing of said return. If no claimant appear,
the Ardent Spirits a nd articles are to be forfeit ed
to CommonweaLth. Any person claiming any o f
same must file a written claim stating particularly
the character and ex tent of his interest therein ,
whereupon the Magis trate shall certify the warrant, written claim and articles claimed, to the
Cir cuit or Corporation Court, as the case may be,
for determination, and decl a re the unclaimed articles forfeited.

The grand jurors in and for the body of said county of
Rockingham and now attending said court at its December term,
1931, upon their oaths do present that Cecil McCarthy, on or
about the 9th day of September , 1931, in said County, did unlawfully and felonious ly manufactu re distilled ardent spirits, against
the peace and dignity of· the Commonweal th of Virginia.
This indictmen t is found on the testimony of John Hawk,
J. L. Dirting, Jerry Long ands. F. Newman, witnesses sworn in
court and sent before the grand jury to give evidence.

qualif ied and free f r om excep t ion; whereu pon, a l ist conta ining
the names of said twenty person s was handed to t he atto r ney for the
Commonwealth and to the accuse d, who each altern at ely struck therefrom the names of four person s, the remain ing twelve , namely ,

An account of the resource
The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. Not every individual was indicted for a criminal offense and many were simply judged as misdemeanors.
