The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. Not every individual was indicted for a criminal offense and many were simply judged as misdemeanors. The transpor t at i on of ardent spirita i s for bidden except in t h ose
cas es wher e i t i s expressly allowed under s ecs. 39 , 39 1- 2 , and62 of
.· the Prol!lib:tion Act. Therefor e ·th e transporta tion of one qua.rt, more
or l ess , from Elkton t o Harrisomburg , merely to be drunk by t he
par ty on t h e t r ip , is unlawful . It is unlawful under sec . 3 of t h e act
and also under sec . 39 .
The accused i n this case denies any knowledge of the s uit case
of bot t les that was in the ~ar , and any par t icipation in or
know-
ledge of the purpose to sell the li quor in Harrisonburg , and he
declares t hat at the time he got aboard t h e car to come to Harr i s on·
burg , by invitation of Pi ttin~t on , that he did not know t.h at t h ere
was any li quor in the car at all .
He admits , h owever , that about t h e time he got i nt o t he car,
or soon after, h e s aw t he quar t bottle on t he seat i n fron t , h e
b ei ng on t h e back seat , and t hat sh ortly aft er t·h ey passed t he
El k ton bridge h e and Pittington and Simmons all t ook a drink, and
that after traveli ng some distanc e , he t ook another drink, and that
Pitt i ngt on and Simmons drank fre quently and were drunk when t h ey
reached Harrisonburg .
Under these c i rcumstances , and on the testimony of the accused
himself , he must be held guilty of unlawful transportatio n , both
under sec . 3 and under sec . 39 , and al s o guilty of unlawfully r ecei
i ng ardent spir it s under sec . 40 - Gui lty of unlawful transpor t a tion
- b ecause of t he transportatio n of t h e di mi nishi ng bo ttle over t h e

The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. 5th, 1920, the said car at the time of
the seizure be-Ing occupied by M.
