THE INSTRUCTIONS set out herein are directed to Mr. George H. Levi, w. L. Green and Miller A. P.riee,whom I have appointed Special Investigators and Members of a Board of Appraisal Commissioners, in these proceedings, and directed to qualit'y before you or your deputy. B~"F0RE administering the necessary oaths of office you will hand each of these gentlemen a carbon copy hereof and file the original with the record. TO MESSRS. George H. Levi, Miller A. Price and W. Green, Special Investigators and Members of a Board of Appraisal Cormnissioners: YOUR duties as Special Investigators and Members of a Board of Appraisal Commissioners are set forth in the Public Park Condemnation Act. In the pertormanee of these important duties, you are subject only to the direction and control of this Court, and the Judge thereof, and this you should bear in mind at all times. The Judge of this Court will hold himself in readiness at all times to assist and advise you in all matters pertaining to the performance of your duties, and invites you to consult him freely in all matters as to which you may be in doubt, except of course the making of such findings of fact, especially as to the value of lands and other interests within the park area as to LAW OFFICES WEAVER & ARMSTRONG FRONT ROYAL , VA . which the law imposes on you the duty of exercising your own uncontrolled and. �independe nt judgment. UNTIL further instructio ns your duties as Special Investiga tors will be limited substanti ally as follows: ( a) TO making diligent inquiry as to the exi stance of lands or interest in lands in the proposed park area in Rockingham County to which infants, insane persons, or persons under legal disabilit y ar-e entitled and lands as to which no claims of ownership have been filed and as to whether there may be sufficien t reason to believe that no such claims of ownership will be filed; (b) YOU are not required at this time to ascertain the values or exact descripti on of suchlands and it will be sufficien t at this time to secure general informati on as to the names of owners, location, extent, etc. which might be useful or necessary if and when a special report is called for with relation thereto; (c} To visit the area sought to be condemned in these proceedin gs and acquaint yourselve s generally with the boundary lines, parcels and tracts into which it is subdivide d, the occupants and owners and the nature of their claims, the character of the soil, crops, and other informati on which you would deem useful if you wourselve s contempla ted "<lfu:ying these lands; ( d) TO furnish blank forms to persons desiring to file claims; (e) ON request, to assist the persons owning or claiming right, title or interest in the lands sought to be condemned to fill out and verify the claim forms furnished them; (f) TO perform duties contempla ted in Section 23 of the Park Condemnation Act. YOUR duties as Member of the Board of Appraisal Commissioners are also set forth in the Public Park Condemnation Act. BY far the most important duty which you will be called upon to perform in the course of these proceedin gs are the making or finding of values of the various tracts, or parcels of land within the park acrea and ot the various claims ot right, title and interest thereto. THE: Act provides compensatio n for your services at the rate of twelve dollars per diem for each day in which you are actually engaged in the performance of your duties; and reimburseme nts for actual expenditure s for travel, lodging, subsistence and other expenses as may be allowed and q,proved by t his court or the judge thereof. A MONTHLY itemized and duly verified statement properly supported by the necessary vouchers, -should be submitted to the Clerk of the Court setting forth your claims for canpensatio n and reimburseme nt. Section 25 of the Public Park Condemnation Act expressly provides for the payment of: "All lawful compensation and allowances to any person employed by or under the direction or the authority of the court or judge for the furtherance of such proceedings which are allowed and approved by the court or the judge thereof , up to and including the entry of the judgment, as in rem, condemning the land, or estate or interest therein , sought to be condemned, may be taxed as a part of the costs of the case and should be paid by the petitioner upon the order or direction of the court or judge thereof • 11 Section 41 provides that: In any case wherein a judgment in rem etc . is entered etc . the court shall etc . enter an appropriate order setting forth such fact , and expressly discharging the petitioner from any further obligation or duty with regard thereto, and declaring that the petitioner shall not there after be in any way responsible for the· disposition or distribution of the fund so paid into the custody of the court, etc . 11 11 The third paragraph of Section 15, which is as follows, is still more explicit ~ 8 �Mr. J. Robert Switzer -2- January 18, 1934. 11 In order properly to determine conflicting rights 01"' cJai.ms of claimants to the fund, the court shall have power to direct issues to be made between such claimants and to require them or any of them to enter into such bond or security for the costs incident to or arising upon a prosecution of their claims, as shall seem to the court meet and proper; but no cost incident to or arising out of a trial or a determination of such issues or out of a determination of the ownership of the fund or the distribution or disbursement thereof after the same has been paid into the custody of the court by the petitioner shall be adjudged against the petitioner, except only, and in the discretion of the court, in any such matter as to which the petitioner shall have exercised his right to intervene under the provisions of section number thirty-nine of this act . 11 It seems very clear from the above cited provisions of the Act that the Petitioner in these condemnation cases is neither authorized nor obligated to pay any such claims as you outline in your letter, and that such claims for services rendered should be paid by the respective distributees of the condemnation awards . So far as it is proper for counsel to express an opinion as to the modest claims for fees or compensation mentioned in your letter, we believe that there would be no real ground for complaint on the part of distributees, who may be charged with such fees or compensation, especially when one takes into consideration the liberal attitude assumed by the ~etitioner, the Appraisal Commissioners, and the Courts in ascertaining and determining the a.:mounts of these awards . It has occurred to us, however, that instead of fixing a flat fee or remuneration to the Clerks who really give special time and attention to the handling of the matters mentioned in your letter, a more equitable arrangement would contemplate a fee of say $1 . 00 in cases where the awards amount to $100.00 or less; $2 . 00 where the awards exceed $100.00 and are less than $ 250 . 00; $ 3.00 where the awards exceed ~250.00 and are less than $500 . 00; and ~5 . 00 where the awards are in excess of ~500.00 . The power of the court to provide for such payments would seem to be established by the second paragraph of Section 15 of the Act in which it is said that: in order to enable or to assist the court in determining a proper disposition or distribution of the fund, 11 �Mr .
