had been introduced/ the defendant, by counsel, prayed the Court
to grant the fol lowing instruc tio ns to the jury, to - wi t:
The Court ins t ruc ts the j ury that the a ccused is presumed to be innocent.

The Court inst ructs the jury t ha t the burden is upon
the Commonwealth t o prove pe yond all reasonable doubt that the
substance contained i n the package de live r ed to the defendant was
distilled spirits and unless this has been done, the jury must
f ind the defendant not guilt y .

The Court instruc t s the jury t ha t neither the express
bill, the a ffidavit n or the express records, nor all of them combmned, are sufficient proof to est ablish the guilt of ~he defendant in this case, for the burden rests on the Commonwealth to
prove be yond all reasonable doubt, that the contents of the packages received by the defendant was distilled spirits.

The Court instructs the jury that the defendant un~

ter the law is entitled to r eceive not oftener than~ach calendar

month, one quart of distilled li quor, and if the jury believe
from the evidence, that the defendant in the months of

and December, 1916 , did receive but one quart of distilled. liquor
in each of s aid months, then the jury will find the defendant;,
