Lizzie J. Knighten, Beatrice K. Smith, Henry Knighten
and Harvey Knighten, and on their motion, by counsel,
leave is given them to file their petition and application
for the distribution of said award made in this case to
John E. Knighten's heirs, the amount of the award set out
in the judgment of condemnation for Tract No. 52 being
$10-M.00.
On motion of Georges. Harnsberger, Guardian ad
Litem heretofore appointed in the above entitled condemnation
proceedings for the infant defendants, Wilson Knighten,
Jessie Knighten, Pearl Knighten and Ha~el Knighten, leave is
hereby given him to file his answer to the petition of Lizzie
J. Knighten, Beatrice K. Smith, Henry Knighten and Harvey
Knighten, and the same is accordingly filed, to which answer
the petitioners reply generally.
And it appearing to the Court from the report of
the Board of Appraisal Commissioners
heretofore filed in
this suit, and in the petition for ju.d8fflent of condemnation,
heretofore entered herein, that in the opinion of the said

with a superior or better right or claim of title in and to
said tract of land designated as No. 52 than any other person
or persohs, and that the record in said condemnation proceedings

interested as to the title to said tract designated as No.
52, or to the proceeds arising fran the condemnation thereof,
except the taxes and the refund hereinafter provided for;
And it further appearing to the Court that Beatrice
K. Smith, ~
Henry Knighten and Harvey Knighten, three of the
petitioners in this matter, desire and request that their
respective shares in said cause be paid to the i r mother,
Lizzie J. Knighten;
Upon consideration whereof, it is ordered by the
Court that the shares of Beatrice K. Smith, Henry Knighten
and Harvey Knighten, to-wit: the sum of $131.74 each, or the
aggregate sum of $395.22 be paid to E. D. Ott, Attorney for
Lizzie J. Knighten; and it further appearing to the Court that
the infant defendants are of the following ages: Wilson Knighten,
twenty years of age, Jessie Knighten, eighteen years of age,
Pearl Knighten, sixteen years of age,Jfazel Knighten, fourteen
years of age; and it appearing further to the Court that the
said Wilson Knighten, Jessie Knighten and Pearl Knighten are
of su.fficient age and discretion to use the :f'U.nd coming to
them in this proceeding judiciously, it is ordered that their
shares of the fund to-wit: $131.74,each, be paid to each of
them; but that Hazel Knighten being an infant of tender years
and residing with her mother, it is ordered that her share of
the f'u.nd to-wit: $131.74 be paid to Lizzie J. Knighte;, her
mother, for her maintenance, education and support; and it is
ordered that the balance of said fund, to-wit: $121.90 be paid
out as follows:
(l) To J. Robert Switzer, Clerk, the sum of $3.90;
(2) To J. Robert Switzer, Clerk, the sum of $2:00; and
(3) To the State Commission on Conservation and
Development of the State of Virginia, the sum

Beatrice K. Smith {nee F.-nighten) , Henry Knighten and Harvey
Knighten respectfully represent:
That John E. F nighten , whose name is
sometimes written Y.nighting, died intestate in 191.i_,
while seised and possessed of a tract of 51 acres , 2 roods
and 39 poles of land , situate on the western slope of the
Blue Ridge Iiountain in the eastern portion of Stonewall
District , Rockingham County , Virginia , near the Fern Hill
Postoffice , ~hich land he acquired from

J . Knighting
by deed dated November 25 , 1918, and which deed is duly
of record in the Clerk ' s Office of Rockingham County ,
Virginia , in Deed Book 111 , page 320;
That the said John E. Knighten left
him surviving his widow , Lizzie J. Knighten , and seven
children , namely , Beatrice K. Smith (nee Knighten) , Henry
Knighten , Harvey Y.nighten , ~ilson Knighten , Jessie Knighten ,
Pearl Knighten and Hazel Knighten , the last four named
children being infants ; the said Wilson Knighten being
twenty years of age; the said Jessie Knighten being eighteen
years of age; the said Pearl Knighten being sixteen years
of age; and the said Hazel Knighten being fourteen years of

age; that all of said children , with the exception of Beatrice
K. Smith, make their home with and are partially supported

by the said Lizzie J . Y..nighten , their mother, the aforesaid
infants being especially dependent upon her .
That the said Lizzie J . Knighten is entitled
to dower in said 51 acres , 2 roods and 29 poles of land ,
of which the said John E. Knighten died seised and possessed ,
the remainder interest in said property being vested in the
said children of the said John E. and Lizzie J . Knighten .
That a judgment in rem has heretofore been
entered in the above entitled proceeding , condemning to the
use of the State Commission on Conservation and Development
of the State of Virginia , the fee simple estate in said
tract of land , formerly the property of John E. Knighten ,
situate in the Blue Ridge l:ountains as aforesaid , which
tract is described in the report of the Board of Appraisal
Commissioners appointed herein , and shown , numbered, and
delineated on the C ounty Ownership Kap filed. therewith ,
as Tract No . 52 , at the price of Jl044 . 00 .
Your petitioners further show to the Court
that all of the taxes on said property have been paid , except
for the year 1918 , for which year said property was returned
delinquent , and subsequently in 1920 the same was sold to the
Commonwealth, that the amount necessary to redeem said property
from the Commonwealth is the sum of ~3.90, as shown by a
certificate made by J. Rob_ert Switzer, Clerk of the Circuit
Court of Rockingham County.
This certificate is herewith
filed , marked trEx . Certificate No . l" , and prayed to be read
as a part hereof; that there is also filed herewith a
certificate fr.om i: . H. Harrison , Treasurer of Rockingham
County, showing that the taxes for the years 1932 and
1933 have been paid.
This certificate is also filed herewith ,
marked "Ex . Certificate No . 2" , and prayed to be read as a
part hereof .

is due to the State Commission on Conservation and Development
of the State of Virginia the sum of ~pll6 . 00 to be paid. out of
the .,pl044 .00 her einabove mentioned, the said 't!ill6 . 00 being
the amount of the refund due on account of the advancement
made by said State Commission on Conservation and Development
of the State of Virginia to the estate of John E. Knighten
on account of the Skyline Drive .

Robert Switzer, Clerk of the Circuit Court of Rockingham
County setting forth the fact in connection with this
matter is herewith filed , marked "EX . Certificate No . 3" ,
and prayed to be read as a part hereof .
That your petitioners further represent that
the aforesaid lien for taxes and the amount of said refund
constitute the only liens binding upon the property condemned
in this cause , and that no other person or persons than
your petitioners and the a foresaid lienors are entitled to
share in the distribution of said award , except the costs
incident to this pr oceeding , namely the sum of ~2 . 00 payable
to J . Robert Switzer ,
Clerk of said Court.
Your petitioners , Beatrice K. Smith , Henry
Knight en and Harvey Knighten , the adult children of the said
John E. Knighten and Lizzie J . Knighten , desire and reques t
that their respective shares in the award for said property
be paid to their mother , Lizzie J . Knighten .

be made parties herein and be allowed to file t he i r petition

The first series of <span>the SNP Records collection consists of 4,756 documents related to The State Commission on Conservation and Development of the State of Virginia v. Cassandra Lawson Atkins and others, and Fifty-Two Thousand Five Hundred and Sixty-One (52,561) Acres of Land, more or less in Rockingham County, Virginia, court case initiated by the state of Virginia in order to acquire 52,561 acres of privately held land located within the northern Blue Ridge Mountains. </span> The Virginia government in collaboration with the federal government, used condemnation, a process that involves the seizure of an individual's private property for public use, without the owner’s consent, but with payment of compensation, and more formally known as “eminent domain,” to create the Shenandoah National Park. The documents within the collection almost entirely refer to land located within Rockingham County, but other counties within the park’s scope followed a similar process to acquire the land. The documents are broken up into three categories: Deed Books, Miscellaneous Documents, and Condemnation Cases.
