I am preparing

your Honor to enter, furloughing

of Section 1041,
as this is the section under
which the hospital
authorities
contemplated
the order would be
entered.
I do not see that it makes any particular
difference
under which section

for the order is based.

Dear Judge Bertram:
I have a copy of Dr. Blalock's
you of November 28, regarding
Mr. Long.
letter
to
The contention
of the Marion authorities
is
that they cannot release
Mr. Long because of the last sentence
of Section 1041 of the Code.
They further
contend, however,
that this section
applies
to the Superintendent
of the Hospital
but not to the Court and their
contention
is based on the fact
that Section 1040 expressly
applies
to both the Superintendent
and the Court and that the Legislature
must have, therefore,
intended Section 1041 to apply only to the Superintendent.
They
say, therefore,
that it was not the intention
of Section 1041
to prevent a court,where
a person wasconvicted,from
furloughing
him with the consent of the Hospital
authorities.
This seems
to be the construction
that the hospital
has put on Section 1041.
Your Honor will see that under Section 1040,
the per on referred
to by this section,
as we understand
it, is
a person (1) "charged with crime and subjectto be tried thereforTT or (2) 11convicted
of crime and subject
to be punished
therefor.TT
Long was convicted
in 1937 and has been in the
Hospital
since July 25, 1937, a period of four years and four
months.
Under Section 4910 the time a person is confined in a
criminal
insane department
shall be deducted from his sentence.
In other words, had Long been in the penitentiary
he would
receive half time off and would now be out.
He would have had
to serve two years and nine months on good behavior and thms his
term would have been up sometime ago.
Therefore,
now as of the
time your Honor would enter an order furloughing
Long, he is
not v1ithin the purview of Section 1040, TTaperson convicted
of
crime and subject
to be punished therefor.n
If he is not, as
provided by this section,
the court may deliver
him to any
ftiend who will give bond with surety as provided by this
section.
With regard to the la_l.t clause of this section,
even
if it be regarded
as applicable1o Long's case, which I do not
think it is because he was not found to be insane after commitment, the letter
of Dr. Blalock,
in effect,
states

Long is harmless
because certainly
Dr. Blalock would not agree
to a parole of Long if he were not harmless.

The second series in the Madison County SNP Records collection consists of 22 files related to the court proceedings from The State Commission on Conservation and Development of the State of Virginia v. D.F. Anderson and Others, and Fifty-Five Thousand Acres of Land, More or Less, in Madison County, Virginia. This was a court case initiated by the state of Virginia in order to acquire privately held land located within the boundary of Madison County in the northern Blue Ridge Mountains. Within the boundaries of eight counties, the state of Virginia, in collaboration with the Federal government, used eminent domain condemnation, a process that involves the seizure of an individual's private property for public use, without the owner’s consent, but with payment of compensation to create the Shenandoah National Park. The documents in this collection are the muniments of title for the condemned land, as found in Deed Book 53 in the clerk’s office of Madison county. Additional items in this collection include appraisal commission reports, addresses of landowners, depositions and proceedings from the law and order books.

Series III is comprised of Rockingham County Indentures of Apprenticeship, which were formal contracts created by the overseers to bind poor or orphaned children to a "master" with who they would learn a trade. Their term generally lasted until the age of twenty-one for males and eighteen for females. Trades were typically determined by the apprentice's sex as well. This indenture witnesseth that I Phillip Brenner one of the overseer of the poor of Rockingham
County Virginia pursuant to an order of court directed to an overseer of the poor, dated
December court 1815 do out and bind Catharine Mason a poor child of Mason born the 1st April
1811 apprentice to Frederick Long to learn her to knit sew and spin (and to give her for freedom
dues twenty dollars lawfull money to serve him until she arrives at the age of eighteen years,
during which time the said apprentice her said master faithfully shall serve his secret his secrets
keeps, his lawful commands every where obey, he shall do no damage to her said master, no
willfully suffer it to be done by others, she shall not absent herself day or night without her said
masters leave, but in all things behave herself as a good and faithful servant or apprentice out to
do in consideration whereof the said master shall provide and procure for said apprentice during
the said term sufficient meat, drink, washing, lodging and apparel sufficient for such apprentice
and teach the said apprentice to read the Bible well and write a tolerable hand, in witness
whereof each party bind themselves their heirs and successors firmly to the others by these
presents sealed with our seals dated the 28th day of July 1817

This indenture made the 18th day of July in the year of our Lord 1803 between Jacob Nicholas
and Henry Cook overseers of the poor in the county of Rockingham of the one part and Philip
Long of the same county aforesaid of the other part witnesseth that the said Jacob Nicholas and
Henry Cook by virtue of an order of the court of the said county in June last have put placed and
bound and by these presents do put place and bind William Long a natural child of Catharine
Rhinehart of the age of eight years to be an apprentice with him the said Philip Long and as an
apprentice with him the said Philip Long to dwell from the date of these presents until the said
William Long shall come to the age of twenty one years according to the act of General
Assembly in that case made and provided By and during all which term and time the said
William Long shall the said Philip Long his master well and faithfully serve in all such lawful
business as the said William Long shall be put unto by his said master according to the wit power
and ability of him the said William Long and honestly and obediently in all things behave
himself towards his master and honestly and orderly towards the family of the said Philip Long.
And the said Philip Long for his part for himself his ex and adm doth hereby promise and
covenant to and with the said overseers of the poor and their successors for the time being and to
and with the said William Long that he the said Philip Long shall cause to be taught and
instructed the said William Long in the craft mystery and occupation of a tanner and currier after
the best manner and in everything that belongeth thereunto or in any wise assertaineth and that
the said Philip Long shall also find and allow unto the said apprentice sufficient meat drink
apparel washing lodging and all other things needful or nect for an apprentice for the said term.
And also that the said Philip Long shall teach or cause to be taught to the said William Long
reading, writing, and common arithmetic including the rule of three; and will moreover pay unto
the said William Long the sum of twenty dollars at the expiration of the said term. In witness
whereof the said parties have interchangeably set hereunto their hands and seals the day and year
first above written

This indenture witnesseth that I Reuben Moore one of the overseers of the poor of Rockingham
County by an order of court to me directed and by these presents I bind out Elijah Lang
apprentice to Solomon Matthews to learn the art and trade of a blacksmith and after the manner
of an appritence to serve the said Solomon Matthews from the day of the date hereof for and
during and unto the full end and term of twenty one years during all which term the said
apprentice his said master faithfully shall serve his secrets keep his lawfull commands at all
times readily obey he shall do no damage to his said master nor see it to be done by others
without giving notice there of to his said master he shall not waste his said masters goods nor
lend them unlawfully to any he shall not commit fornication nor contract matrimony within the
said term at cards dice or any other unlawfull game he shall no play where by his said master
may have damage with his own goods nor the goods of others without license from his master he
shall not buy nor sell he shall not absent himself day or night from his said masters service
without his leave nor haunt alehouses taverns nor playhouses but in all things behave himself as
a faithfull apprentice ought to do during the said term and the said master shall use the utmost of
his endeavours to teach or cause to be taught or instructed the said apprentice in the trade or
mistery of a blacksmith and to give him the said apprentice sufficient freedom dues and procure
for him sufficient meat drink cloathes washing and lodging fitting for an apprentice during the

The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. Not every individual was indicted for a criminal offense and many were simply judged as misdemeanors. The first series of <span>the SNP Records collection consists of 4,756 documents related to The State Commission on Conservation and Development of the State of Virginia v. Cassandra Lawson Atkins and others, and Fifty-Two Thousand Five Hundred and Sixty-One (52,561) Acres of Land, more or less in Rockingham County, Virginia, court case initiated by the state of Virginia in order to acquire 52,561 acres of privately held land located within the northern Blue Ridge Mountains. </span> The Virginia government in collaboration with the federal government, used condemnation, a process that involves the seizure of an individual's private property for public use, without the owner’s consent, but with payment of compensation, and more formally known as “eminent domain,” to create the Shenandoah National Park. The documents within the collection almost entirely refer to land located within Rockingham County, but other counties within the park’s scope followed a similar process to acquire the land. The documents are broken up into three categories: Deed Books, Miscellaneous Documents, and Condemnation Cases. History of Tract and condition of timber: The tract has been cut over many times
and the saw timber removed about 1924 . 'i portion was severely
burned in 1929 .
There is a considerable amount of very good
white oak and a sma11 ·amount- of chestnut oak from 4" to 14"
with a few white pine, red oak and hickory . On the western
end there is considerable white oak . On the Hawksbill Creek

oaks .

Comes now the claimant, M. H. Long, and asks and requests the
Court to set aside, decline to accept and disap~rove the report of
the Board of
ppraisal Commissioners filed in this cause with
reference to this defendant in Tract No . 152, which said tract
contains 520 acres, and is situate near Elkton, in Stonewall District
Rockingham County , Virginia; for the following reasons :

ppraisal Commissioners is grossly inadequate.
Because the said Board of Appraisal Commis sioners made no
allowance for dama0 e to the remaining land of movant .
(3) . Because the finding or findings in ~uestion are so manifestly
inade uate ,.1hen consid.ered together with the evidence before the
Court, as to j us tify a finding that in making such findins or findingv
·the Board. of appraisal Commissioners or some of ther:i were affecteor influenced by some mistake of law as to the nature and effect of
the evidence, 1ith reference to which such finding or findings were made
,lherefore, the said M. H. Long prays the Court that an order
may be entered setting aside, declining to accept, and disapproving
the report of the Board of Appraisal Commissioners in so far as it
relate i to or affects the said lands owned and. claimed by the said

I , M. H. Long, herein submit to your hoflor~ard a
statement of Tract No. 152 of the Park Survey, containing about
523 acres ,
which I will endeaver to describe to the best of my
ability, as to its quality and value :
This tract No . 152 of the Park Survey , lies on the east side
of the Shenandoah River and about two miles south of~lkton , Virginia,
lying on both sides of the Hawksbill Valley and extending about two
miles back , all being in Rockingham County.
I will sub - divide it as follows :
The Bryant Tract ; Nall Tract ;
Yancey and Laws on Tract , and the r ernainder a part of the Magret
Tract of which my residence is a par t.
Tract No . One : Taking up the Bryant tract , containing about
23 acres , is mostly flat , running back to slope . There is no part
of this tract that is not accessible to wagon and team .
A good
portion of this tract would be good agricultural land , if any more
land was needed, but as there seems to be too much land in agriculture
now, we will put i t in to reforestation .

From experience in cutting wood to
delive r to ~lkton for fire wood , I would say it will grow about
three - fourths of a load per year , exclusive of the pine , earning
37 1/2 ~ pe r acre per year or the i nterest on ~6 . 25 .
The pine cut
about 200 , 000 staves on about 7 a cres of thirty year gr owth , making
476 to the acre per year , earning 476 ¢ or the interest on ~8 . 00 .
From these figures , I would say ~7 . 00 per acre .
Tract No . Two :
The Nall tract , contains 150 acres , running
back into the Park A.!'ea about two miles , it be i ng a narrow strip
through the Hawksbill Valley .
About half of it is low ground and
was under cultivation , until it was converted to pasture purposes ,
and is well adapted to blue grass .
Along the banks of the stream, all

the t irnbers of this latitude are in growth , especially black
walnut, of which there is somewhere between three hundred and
four hundred.
The remainder o f this tract , of about seventy-five
acres , consists of cove , slope , ridge and cliff and is adapted to
forest and cattle range ; range value will be included in pasture
value, and the forestry values (as estimated in the Bryant tract ,
it not being in the range and is estimated separately) included in
growing timber .
Tract No . Three :
The Yancey and Laws on Tract , c· on taining
about 68 acres , more or less , and is mostly slope land, accessible
to wagon and team , and has a good a.mount of stave timber on it;
that will be listed separately, it having a present market value;
and also it is adapted to forestry , especially chestnut-oak and
chestnut and cattle range , and will be in cluded in pasture value
and growing timber .
Tract No . Four :
The Magret Tract, it being divided by the
Park Survey , I have no way of knowing just how much is in the
Park Survey except (well , by :messing at it) .
land , except the "Giant ' s Grave" .
It is all flat
About half of this flat land
is adapted to reforesting as it was burnt over a few years ago , but
has a good amount of stave timber that was not injured by the fire.
;. eforesting and cattle range will be included in Pasture and
growing timber .
The remainder of this flat land is of much more
value and I wish to call your attention to an area of about 50
acres, lying along what is known as Hanse 1 s Run , and heavily timbereQ
with white and chestnut oak, of a wonderful growth , but just a
little to small to be of a market size .
I will place it in with
gr ov.ri. ng timber and pasture , which adds cons id er able to growing
timber, but very little to pasture .

The "Giant ' s G:rave" is a foot - hill :ridge , s i tting out from the
main mountain and having the shape and appea:rance of a large g:rave ,
f:rom which it has de:rived its name at a time further back than I know
and is marked on all the Park maps by that name .
It is fenced in
f:rom the rest of the range and timber land , having a good woven
wire fence around it and containing about 100 acres .
It has been
cut over and stocked with goats for the purpose of an orchard ,
being highly recommended by M:r . V. S . Campfield, then County Agent,
it being of a good soil and in an atmospheric pos i tion for orchard
pUl'poses .
When Mr . Stuart was laying out the Park Boundary, I asked
him to come to my place ahead of the Survey and I insisted that
he leave it out , which he seemed inclined to do , until he recalled
that it was the "Giant ' s Grave" and he said , "I can ' t let you
have it" .
I offered him to take "~2 , 000 . 00 less for the whole , but
to no avail , he took it in , and with that assurance , I sold the
goats , taking a loss of Rl28 . 00 .
If it was worth ,}2 , 000 . 00 to him, it should be V1AJrth that
much to me , but owing to the uncertain condition of the o~chard
business , we will consider it for other purposes .
It grew 25 loads
of wood in 26 years just before it was cut over and it being well
fenced and in close proximity to the remainder of my place , being
nor more than fifty yards from my barn , I feel that it is well
worth Jl , 000 . 00 to the place .
Now in reference to Residual damage , I hope your honor will
consider the condition it will leave the remainder of my place
having no pasture range for stock - cattle and not being able to
keep stock cattle and nothing to consume the roughfeed from the
place , which will reduce the fertility of the home place, and
will disrupt my entire system of farming .
this will be , is hard to estimate .
Just how much damage
Furthermore , when this land

is taken, it will not leave firewood for more than a year or two
and then it will be to buy coal for all gen er at ions to come.
You might also consider the expense and trouble I have been
put to in protecting my interest .
I am the fee simple owner of said Tract No . 152.
I have been unable to classify my said land as to acreage ,
but have arrived at its value in the following manner:

�The basic difference s between Petitione r and this exceptant
are as to classifica tion and value of the land, timber values, and
amount of incidenta l damages .
Although we believe the values reported by the Petitione r ' s
appraiser s were very liberal and that the findings of the Board of
Appraisal Commissio ners as to values are substanti ally too high, we
have accepted and will not seek a lower valuation than their findings as shown on the above tables in this case .
As to the classifica tion of the land and the other elements
of value we submit that these matters are correctly set forth in
the Work Sheet of the Board with reference to this case, and not
as set forth in exceptant 's ·statement s .

Comes now the claiman t, M.H.Long , and asks and requests the
Court to set aside, decline to accept and disappro ve the report of
the Board of Apprais al Commiss ioners filed in this cause with
referenc e to this defendan t in Tract No . 152, which said tract
contains 523 acres, and is situate near Elkton, in Stonewa ll District
Rockingham County, Virginia ; for the followin g reasons :
(l) Because the value placed upon said land and timber by the
Board of Apprais al Commiss ioners is grossly inadequ ate.
(2)
Beoauxe the said Board of Apprais al Commiss ioners made no
allowanc e for damage to the remainin g land of movant .
Because the finding or findings in question are ao manifestly inadequ ate when consider ed together with the evidence before
the Court, as to justify a finding that in making such finding or

findings the Board of ~pprais al Commiss ioners or some of them were
affected or influenc ed by some mistake of law as to the nature and
effect of the evidence , with referenc e to which such finding or findings were made
Wherefo re , the said 1~.H.Lon g prays the Court that an order
may be entered setting aside, declinin g to acce pt, and disappr oving
the report of the Board of ppraisa l Commiss ioners in so far as it
relates to or affects the said lands owned and claimed by the said
M.H.Long.
Said M.H.Long further moves the Court to exclude his said
lands from the Park area and to release his said lands from the

The first series of <span>the SNP Records collection consists of 4,756 documents related to The State Commission on Conservation and Development of the State of Virginia v. Cassandra Lawson Atkins and others, and Fifty-Two Thousand Five Hundred and Sixty-One (52,561) Acres of Land, more or less in Rockingham County, Virginia, court case initiated by the state of Virginia in order to acquire 52,561 acres of privately held land located within the northern Blue Ridge Mountains. </span> The Virginia government in collaboration with the federal government, used condemnation, a process that involves the seizure of an individual's private property for public use, without the owner’s consent, but with payment of compensation, and more formally known as “eminent domain,” to create the Shenandoah National Park. The documents within the collection almost entirely refer to land located within Rockingham County, but other counties within the park’s scope followed a similar process to acquire the land.
