The motion o:f Maude M. Shipp praying the said Court to disapprove
and to decline to accept the findings o:f the Board of Appraisal Conmissioners
heretofore appointed by the said Court in the above matter, wherein the said
Board reported under #84 of its findings, as filed in the Clerk 1 s Office of
Rockingham County, stated that oove~ is only entitled to TWENTY THREE HUNDRED
DOLLARS ($2 ,300.00) for the tract of (20) acres of land with the improvements
thereon situated at Swift Run, through which the Spottswood Trail passes, which
land was conveyed to rri.oveilui by Roy Shipp by deed now duly of record.

The amount allowed for the land with the improvements thereon
by the said appraisers is wholly inadequate and unjust, and amounts to a taking
of the property vii thout just compensation, as guaranteed by the Consti tutiono
The land is a clay loam, very :fertile, and as stated, lies on both sides o:f the
Spottswood Trail, and for which land unimproved the moveant was offered 125000
per acre, which she declined to accept, and has actually sold off since this
proceeding has been pending (l) acre at the price of ~125 .00, leaving this moveant owning (19) acres of land.
This land lies right at stores, postoffice,
schools and churches, and is in a splendid neighborhood.

tion-roofed dwelling, 18 x 20 feet, sealed, with metal-roofed sleeping

The Petition of Maude M. Shipp respectfully re~resents:
That by deed dated the 22 day of July, 1922, Roy
D. Shipp conveyed to Petitioner, Maude M. Shipp, a certain tract
or parcel of land, adjoining the lands of Joseph W. Baugher, J. L.
Maiden and others, and situated near Swift Run in Stonewall Dis trict of Rockingham County, lying wholly within the outside limits
of the Shenandoah National Park.
That by deed dated April 4, 1933, your Petition
er conveyed 1 acre more or less of land to Arthur N. Dean, upon
which the said Dean constructed a new dwelling, and the necessary
outbuildings, that all of this was done after the Board of Appraisl
al Commissioners had appraised Petitioners land, and a'.1-1. of this
fact was subsequently reported to the Board of Arbitrators, composed of Judges Bertram, Williams, Glasgow, Alexander and Smith,
and that a judgment in rem was entered in the above entitled cause

awarding to Arthur N. Dean, the sum of $693 .22, and to Petitioner !
the sum of $2300 .00, a total allowance for said tract No. 84, as
it appears upon the report of the Board of Appraisal Commissioners
of $2993. 22.

the fee simple title to the afor·esaid tract of land numbered and
described as Tract No. 84, in accordance with the findings of the
Arbitrators, J"udges Bertram, Glasgow, Williams, Alexander and
Smith, upon the payment into the custody of the Court of the amoun
of the award to-wit, tract No. 84, $2993.22.
Your Petitioner would further represent that of the
said sum of $2993 .22, she is entitled to the sum of $2300.00 for
that portion of the land which she retained, and that Arthur N.
Dean is
entitled to the sum of $693 .22 for that portion of the
land conveyed to him by Petitioner, and upon which he erected his
residence and outbuildings.
Petitioner avers that she and the
said Arthur N. Dean have the superior right and title to the said
lands and that no person other than A. N. Dean and Petitioner have
any interest therein;
that she and the said Arthur N. Dean are th
owners in fee simple of the entire tract known as No. 84, that Deaf
owns about 1 acre of the land with the buildings thereon, and that I
Petitioner is the owner of the remainder with the buildings occup- 1
led by her;
that the State Commission on Conservation and Develop !
ment of the State of Virginia, has paid to the Treasurer of Virginia, in satisfaction of said judgment, the sum of $ 2993.22, $230~

The Petition of Arthur N. Dean respectfully rep resents:That by deed dated the 22 day of July, 1922 ,
Roy D. Shipp conveyed unto Maude M. Shipp a certain tract or parcel of land situate near Swift Run, in Stonewall District , adjoining the lands of Joseph W. Baugher, J . L. Maiden , and others , and
that the said tract of land owned by Maude M. Shipp , lies wholly
within the out side limits of the Shenandoah National Park .
That by deed dated the 4th day of April , 1933 ,
Maude M~ Shipp, conveyed one acre more or less of said land to you
Petitioner , and upon the said 1 acre, your Petitioner constructed
a new dwelling and the necessary outhouses.

That all of
this was done after the Board of Appraisal Commissioners· had ap praised the lands to Maude M. Shipp .

sequently reported to the Board of Arbitrators composed of Judges, !
Bertram, Williams, Alexander, Glasgow and Smith, and that a judg'
ment was entered in the above entitled cause awarding to Maude M.

the Court of the amount of the award therefor, to-wit:

one acre thereof, with the buildings thereon, and that Maude M.
Shipp is the owner of about 20 acres thereof, with the buildings

The first series of <span>the SNP Records collection consists of 4,756 documents related to The State Commission on Conservation and Development of the State of Virginia v. Cassandra Lawson Atkins and others, and Fifty-Two Thousand Five Hundred and Sixty-One (52,561) Acres of Land, more or less in Rockingham County, Virginia, court case initiated by the state of Virginia in order to acquire 52,561 acres of privately held land located within the northern Blue Ridge Mountains. </span> The Virginia government in collaboration with the federal government, used condemnation, a process that involves the seizure of an individual's private property for public use, without the owner’s consent, but with payment of compensation, and more formally known as “eminent domain,” to create the Shenandoah National Park. The documents within the collection almost entirely refer to land located within Rockingham County, but other counties within the park’s scope followed a similar process to acquire the land. The documents are broken up into three categories: Deed Books, Miscellaneous Documents, and Condemnation Cases.
