Of what is the defendant found guilty?
It will be noted th at he is not found guilty as charged in th e
warrant but simply found guilty as charged.
We submit that
this is not sufficien t.
In conclusio n we would say that while we understan d
that a warrant is informal , and that the strict rules which
apply to an indictmen t do not prevail to the effect of the
construct ion of a warrant, yet a warrant is a pleading upon
which the accused is deprived of his property or his liberty
or both and there are certa in fundame ntal rules which must
be observed.
( a) There must be a proper complaint . ( b) It must
cha rge an offense against the law of t he land .
It is submitted that the warrant in question shows
neither that it is made upon a proper complaint nor that he
charges an offense punishabl e under the law.

the Ardent Spirits and articles are to be forfeited

same must file a written claim stating particul arly

Circuit or Corpora tion Court, as the case may be,

The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. Not every individual was indicted for a criminal offense and many were simply judged as misdemeanors. The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. Not every individual was indicted for a criminal offense and many were simply judged as misdemeanors.
