hia favor, whioh it is the dut7 of the Commonwealth, before it oan
ask for a oonvi otion, to overcome by eviden ce which estab lishes the
guilt of the accuse d beyond every reason able doubt , theref ore if the
~ury after hearin g the whole case enter tain any reason able doubt as
to the guilt ef the accuse d, it is their dut7 to find him not
guilty ; end the Court furthe r tells the jury that a reason able doubt
is that state of the case which after compa rison and consi derati on
of all the eviden ce, leaves the minds of the jurors in such condi tion
that they canno t say that they feel an abidin g convi ction to a moral

If only Ardent Spirits and containers be seized,
the Magistrate shall fix a time not less than 10
nor more than 30 days from the date of return, for
the hearing of said return. If no claimant appear,
the Ardent Spirits and articles are to be forfeited
to Commonweal1th. ·Any person claiming any of
same must file a written claim stating particularly
the character and extent of his interest therein,
whereupon the Magistrate shall certify ,t he warrant, written claim and articles claimed, to the
Circuit or Corporation Court, as the case may be,
for determination, and declare the unclaimed articles forfeited.
3. If Ardent Spirits are being transported in an automobile, boat, wagon, buggy, or other vehicle, the

The first series of the Prohibition Records collection consists of all criminal case records associated with cases brought to the <strong>Rockingham County Circuit Court</strong> from 1916-1964. possession ardent spirits, against the poo.ce and dignity of the

Rockingham and now attending said Court at i ts Oct ober term , 1 926 ,

prior to the finding of this indictment , in said county of Rockingham, did unlawfully manufacture, sell , offer , keep , store and expose
for sale, give away , transport, dispense , solicit , advertise and re ceive orders for ardent spirits, a gainst the pe a ce and dignity of
