�Bio/Historical Note

The United States Department of War was the department originally responsible
for the operation and mantainance of the Unisted States Army until the United
States Department of Defense was established in 1949. Its responsibilities
included recruiting, training, procurment of supplies, ensuring medicare care,
transportation, and payment. From some of the records housed in this collection, it
would seem that the Department also had a hand in determining and verfying
requests made by soldiers for military pensions. Military Pensions were initially
established during the American Revolution, however this "military pension plan"
went under several revisions before coming down to us in its exisiting form. The
Civil War particularly prompted significant change to the military retirement
system which placed limitations on the size of retirement lists. This caused issue,
as many of the officers who should have been retired and receiving a pension due
to physical or mental infirmities were maintained on the "active" list, inhibiting
them from receiving their payment. However, in 1890 the situation was resolved
with legislation that mandated all officers failing to qualify physically were to be
placed on an "unlimited" retired list. The following pension documents record
some of Rockingham County's earliest military officials to receive pension and
trace the ever evolving policy of military pensions. This collection also housed
records pertaining to WWI, WWII, and the Vietnam War. Most of these are
induction and/or discharge records

�Scope and Content

The Military and Pension Records collection is broken into nine series. They are
as follows; Muster Rolls, Confederate Pension Board Records, Pension Records,
Destitute Veteran Records, Militia Appointments, Militia Fines and Costs,
Miscellaneous, World War Memorial Record, and WWII and Vietnam Induction
and Discharge Records. The first series, Muster Rolls, is broken into two
subseries, the Muster Roll for 1861-1865 and one for 1887-1919. Muster rolls
generally contain names of officers and enlisted men, name of station, rank, date of
enlistment or reenlistment, date of desertion and apprehension, and sentence of
court-martial, including the offense upon which found guilty. The Confederate
Pension Board Records consititutes the second series within this record group.
They have been divided into two subseries; General records and Meeting Minutes.
The meeting minutes are recorded for years 1900-1930 and discuss lists of
persons included on the Pension List, claims against the pension board, and new
applications for pensions, among other things. Pension Records have been broken
into three subseries; Applications for Pensions, Pension Lists, and Pension Laws.
The fourth series, Destitute Veteran's Records, houses several letters on behalf of
various veterans requesting either monetary aid or artifical limbs. The fifth series
houses militia appointments, the sixth Militia Fines and costs, and the seventh
series is a miscellaneous folder. The final two series are comprised of bound
induction and discharge books for WWI, WWII, and the Vietnam War. Here
information such as service members name, DOB, occupation, residence,
regiment, and military theater can be found.

Bio/Historical According to Kelly M Pyrek in an article title, "An Introduction to the US MedicoNote
Legal Death Investigation System," a coroner is a public official, appointed or elected, in
a particular geographic jurisdiction, whose official duty is to make inquiry into death in
certain catagories. (Pyrek, https://doi.org/10.1016/B978-012370861-8/50008-5) While
the office of the coroner has been around for centuries, coroner's offical duties have
changed throught their history. In contemporary times, the coroner typically inquires
into a death and then completes a certificate of death. Coroners are different from
medical examiners and jurisdication often determines which of the two are required to
inquire into the death of an individual. A medical examiner is a registered physician who
is expected to bring medical expertise into the examination. A coroner is not required to
be trained in medicine. In the following records you will find both Medical Examiner's
Reports and Coroner's Inquests, which fall under the category of post-mortem
investigations. Additionally, there are some records related to "Lunacy cases." The term
"lunancy" is, of course, an antiquated term generally refering to those considered
epelectic or mentally ill. While the term luncacy has been used since the early modern
period, the "Lunatic Asylum" to which many of the records allude to, was a creation of
the 19th century in America. This was due, in part, to the humanitarian reform
movements of the century, as well as to to an opposing development; the increased
restrictions through institutional power and criminalization. The majority of "Lunacy
records" for Rockingham County are housed at the Library of Virginia, located in
Richmond, VA as part of their Western State Hospital records. A link to the full finding

�Scope and
Content

The following collection is divided in into three series: Medical Registers, Post-Mortem
Investigations, and Lunacy Records. The Medical Register is a bound volume
containing a record of all physicians registered within the Rockingham County Court's
jurisdication from 1968-1985. This book is labeled volume two, however, it seems
volume one was not retained. Within the Post-Mortem series there are two subseries:
Coroner's Inquest and Medical Examiner Investigations. Coroner's Inquests contain
information regarding the appearance of the body upon investigation, made by an
appointed coroner. These inquest also contain depositions made by individuals who
came into contact with the deceased shortly before their death. These depositions
typically relate where the deceased had been, any unusual behavoir they may have
exhibited, their health, and their relationships with others. Medical Examiner's reports
contain much less detail regarding the lives of the deceased leading up to their death.
Here, informtation regarding the name, age, sex, cause/date/time of death, and a
narrative summary of circumstances surrounding the death are relayed (typically no
more than a paragraph). Lunacy Records are divided into two subseries: Costs Allowed
and Depositions. If an individual was suspected of "lunacy" a court investigtion would
be made. This included the examination of witnesses who answered questions related to
the accused's name, age, occupation, martial status, children, education, indications of
insantity, frequency of attacks, promintent symptons and several others. Costs Allowed
are records detailing the costs of caring for any person deemed "insane" who were cared
for by an individual of the community. Evidence had to be supplied of the attempt to
commit the insane to the local asylum, then once proven, any costs associated with their
upkeep were accessed by the court.

�Bio/Historical The first law on adoption in the US was not passed until 1851. The Massachusetts
Note
Adoption of Children Act was not only the first adoption law, but also the first law to
protect the interest of the adoptive child. This law marked a fundamental shift in society,
as during the mid 19th century novel notions of childhood developed and emphasis on
reform of the individual increased. Benevolent Organization's focused on establishing
orphanages, were they could work to reform the individual prior to their arrival in a new
home. The Civil War brought a halt to most adoptions, which led to the overcrowding of
many of these orphanages. The precursor to modern foster care developed out of the
need to move children from these overcrowded orphanages. As the century progress,
several states instituted legislation on adoption, and further regulated the process. By the
1990s, adoption became a highly regulated system with a degree of openness.
Naturalization is defined as, "the admittance of a foreigner to the citizenship of a
country." According to the National Archives, prior to September 27, 1906 any court of
record could grant United States citizenship. However, after this date the responsibility
for naturalization proceedings was transferred to the federal courts. Throughout the early
to mid 20th century naturalization was a two-step process. After residing in the US for
two years, an individual could file a declaration of intention to become a citizen. After
three years, the individual could petition for naturalization. Throughout the twentieth
century immigration became a contentious topic. In 1924 the Johnson-Reed Act, or
Immigration Act, was enacted. Nationalism and xenophobia fueled concerns of foreignborn peoples taking up residence in the U.S. This reduced the number of individuals
allowed into the nation, and as a result, the immigration influx into the area dwindled.
Immigration quotas were eventually repealed during the 1960s, yet, even today
immigration remains a hotly debated topic.
Historically, couples interested in marrying were required to fulfill several prerequisites
before the State allowed them to enter into matrimony. Each party had to be of a certain
age, must prove their identity, and provide evidence for the potential to provide for their
family. It has been argued that such measures were attempts made by the State for
political and social regulation and power. In determining eligibility for marriage, the
State could effectively police unwanted unions and enforce adherence to their definition
of "acceptable" unions. The process for marrying could be quite arduous, requiring the
individual to obtain petitions to obtain marriage licenses, certifications of their age/date
of birth, and written consent from their families.

�Scope and
Content

The following collection is broken down into five series: Adoption Records 1892-1950;
Citizenship Records; Register of Births 1862-1894; Marriage Records; Register of Death
1870-1894. The Adoption Records contain completed adoption case files from 18921950. Within each file, one can find the birth name of the adopted child, information on
who the birth mother and/or father was, as well as information on the adoptive parents.
Files also contain character witness statements and social worker reports, all related to
determining the suitability of the potential adoptive parents. Due to the code of VA
section 63.2-1245, these records are not eligible for use or view by the general public
and are only to be made available to attorneys of record, social service officials, court
officials, and to such other persons as the circuit court shall direct in specific cases by
order of the circuit court entered in accordance with § 63.2-1246.
The second series, Citizenship Records, is further divided into two subseries; Petitions
for Naturalization and Declarations of intent, based on the provenance of these records.
Typically, an individual wishing to gain citizenship during the 20th century would first
fill out a Petition for Naturalization, then the Declaration of Intent. Petitions typically
listed the full name of the petitioner, their present address of residence, occupation, date
of birth, the date on which they emigrated, the country from which they emigrated,
where they arrived and on what vessel, a list of any children they had and finally, from
what government they wished to renounce citizenship. Within this volume there are but
two completed petitions, both of which are dated 1909. Declarations of Intent list similar
information, however, they do provide detailed descriptions of physical characteristics of
said person, including; skin color, complexion, height, weight, hair color, eye color, and
any visible marks. In the entire volume, there is but one form completed, which is dated
1909.
There are eight books containing Birth records housed by the circuit court. The first is a
general index to all births recorded for the county of Rockingham from 1862-1894. This
book provided the name of the child, date of birth, and what book and page their birth

�had originally been recorded in. The courthouse retains both an original and typed
edition of birth records for 1862-1870. The typed edition was likely produced some time
in the late 1890s or early 1900s. In both books, one can expect to find the name of the
child born, the date, their race, sex, place of birth, father's name, father's occupation,
father's residence, mother's name, the number of children at birth, any deformities, and
the name of the person providing birth information. The next two books are the original
handwritten records recorded by the Commissioner of Revenue for each district for the
years 1870-1894. The same information can be found in here as in the 1862-1870
volume. The two final books are typed editions of all birth records from 1870-1894.
Marriage Records are divided into four subseries; Petitions to Obtain Marriage License
1875-1905, Certifications of Age 1872-1899, Consent to Grant Marriage License 18531901, and miscellaneous Marriage Records. Note that the Circuit Court also houses a
copy of all marriage applications/licenses for the county of Rockingham from 17781912. These are available for viewing on our in-house records system, accessible to the
public Mon-Friday 8:30 am-5pm.
There are two Registers of Death, both dated 1870-1894. The first is the original
handwritten documentation filled out each year by the district Commissioner of
Revenue. Here, one can find the full name of the deceased, their race, sex, date of death,
place of death, cause of death, age, name of parents, where they were born, occupation,
name of spouse, and name of the person providing death information. The forms are
arranged chronologically and by district. The second book, which also dates from 18701894, is simply a copy of the original, likely produced some time in the late 1890s or
early 1900s. These are typed rather than handwritten.

Note

In the pre-revolutionary era, the substantive criminal law of Virginia greatly resembled the laws
of England, so far as they were applicable to their situation. English law was supplemented or
amended in the general assembly, but the basic laws, including all serious criminal offenses,
were English law. Death was the penalty for many serious crimes in the colony, as in the mother
country. The Act of 1796 was a bill that abolished the death penalty for all crimes committed by
free persons except murder in the first degree. The bill directed the governor to purchase land
within the state for the purpose of building a penitentiary, inaugurating imprisonment as the
punishment for all other crimes. The bill also established minimum and maximum sentences for
each crime, according to the gravity of the offense. The power to set the sentence was also given
to the jury, rather than being a judicial decision. These laws focused predominantly on white
men and women; the enslaved population was still disproportionately punished with physical
violence or death. In the years after 1796, very little changed about the criminal code. The length
of sentences might vary according to the times. Seduction, previously a civil case, became
criminalized in 1849 and remained so until 1977. Further, several crimes (arson, rape, attempted
rape, burglary, attempted robbery, and kidnapping) have since become capital offenses,
authorizing the death penalty as a possible sentence. In most cases, however, the punishment
remains imprisonment, as it has since 1796.

Scope and
Content

The collection contains the Criminal Court Records from Rockingham County. The records
included are criminal case records, warrants, appeals, summons, register of convicts, prison
records, recognizance, bail bonds, jury records, pardons, and complaints. The criminal case
records are cases that were tried in front of a jury. Warrants are separated into two subseries,
search warrants and arrest warrants. The appeals series contains the records of appeals by people
regarding their original conviction. The records contained within the summons series are witness
summons, jury summons, and defendant summons. The original summons records may also
contain the judge’s verdict for a case, if the criminal case did not go to a jury trial.
